In force as of 20 October, Decree-Law 291/2007* transposes into internal legal order Directive 2005/14/EC of the European Parliament and of the Council, commonly known as the 5th Motor Insurance Directive.
This new document determines, under no.1 of Article 12, the updating of the minimum amounts for compulsory civil liability insurance in respect of the use of motor vehicles. Distributed in smooth and progressive phases, both in terms of the 5-year transition period and of limits per claim, the process will occur, for most contracts, in the following fashion:
- EUR 1,200,000 per accident for bodily injury and EUR 600,000 per accident for material damage, as of 21 October 2007;
- EUR 2,500,000 per accident for bodily injury and EUR 750,000 per accident for material damage, as of 1 December 2009;
- EUR 5,000,000 per accident for bodily injury and EUR 1.000,000 per accident for material damage, as of 1 June 2012;
As of 1 June 2012, the amounts envisioned in item c) shall be subject to revision every five years, according to the European Commission proposal, in function of the European consumer price index, under the terms of Regulation (EC) no. 2494/95 of the Council of the European Union (23 October) regarding the harmonised index of consumer prices.
